These Online Ordering Terms apply to all orders placed with Rock Solid Mixer Hire Ltd. By placing an order with us, you agree to these terms.
1. Ordering
All orders placed online, by phone, or by email are subject to acceptance by us. A contract is only formed when we confirm your order or dispatch the concrete or related services.
We reserve the right to refuse or cancel an order if:
- the product is unavailable;
- there is a pricing or website error;
- the delivery address is outside our service area;
- site access is unsuitable or unsafe;
- payment cannot be authorised; or
- circumstances beyond our control prevent supply.
2. Pricing
All prices are subject to VAT at the current rate.
Quotes are valid for 7 days unless stated otherwise.
Online prices are based on the information you provide, including mix type, quantity, distance, access, and any extras such as pump hire or additives. If the information supplied is incorrect or incomplete, we may adjust the price.
Additional charges may apply for:
- waiting time;
- extra concrete supplied;
- pump-related charges;
- failed or aborted deliveries;
- disposal of undischarged concrete;
- short-notice changes;
- Saturday or out-of-hours deliveries; and
- access-related costs caused by site conditions.
3. Payment
Payment is required before delivery unless you are an approved account customer.
Approved account customers must pay within 30 days end of month, unless agreed otherwise in writing.
Online orders may be subject to a pre-authorisation hold on your card for the order value plus an additional 15% buffer to cover possible extras such as waiting time or additional volume.
The final amount taken will reflect the actual cost of the order.
4. Delivery Area
We generally deliver within 15–25 miles of our batching plants at:
- Bayton Road Industrial Estate, Exhall, CV7 9EJ
- Saxby Road Industrial Estate, Melton Mowbray, LE13 1BS
If your site is outside this area, please contact us before ordering.
5. Delivery Times
Delivery times are estimates only and are not guaranteed.
We will make every reasonable effort to deliver on time, but delays can happen due to traffic, weather, vehicle breakdowns, road restrictions, site delays, or other circumstances beyond our control.
6. Site Access
You are responsible for ensuring safe and suitable access for our vehicles and any associated equipment.
Our trucks may be up to 9 metres long, 3.3m wide and 32 tonnes gross weight. You must make sure the site entrance, road surface, delivery area, and access route are suitable.
You are also responsible for protecting:
- driveways;
- paths;
- paving;
- kerbs;
- grass verges; and
- underground services.
If our driver believes the site is unsafe or unsuitable, we may refuse delivery or discharge. Charges may still apply.
7. Offloading Time and Waiting Time
Ready-mix concrete is a perishable product and must be discharged promptly.
The following offloading times are included in the price:
- 1m³ to 3m³: 30 minutes
- 4m³ to 5m³: 45 minutes
- Over 5m³: 1 hour
Offloading time starts when the vehicle is ready to discharge on site.
If unloading takes longer than the included time, waiting time will be charged at £2 per minute plus VAT.
You are responsible for ensuring there is enough labour, equipment, barrows, and access to unload the concrete without delay.
8. Pump Hire
If you order pump hire through us, we may arrange this using a third-party pump provider.
You must provide accurate information about access, distance to pour, hose length, and site conditions. Any pump-related delays, cancellation charges, abortive visits, or extra costs caused by incorrect site information or site conditions may be charged to you.
It is advisable for you to provide polythene sheeting or similar protection to help contain any mess arising from pumping operations.
You must provide a suitable washout area for the pump, in a safe and appropriate location.
You must also provide 1 to 2 bags of cement, depending on the length of line required, so the pump operator can prime the pump. If cement is not provided on site when required, additional charges may apply.
9. Product Specification
All concrete is batched in accordance with BS EN 206 and BS 8500, where applicable.
It is your responsibility to ensure you order the correct mix, strength, slump, quantity, and any additives for your job. We can give guidance, but the final decision remains with you or your engineer, architect, or contractor.
10. Water Added on Site
If water or any other material is added on site without our agreement, this is entirely at your risk and may affect the quality and performance of the concrete.
Once the concrete has been discharged, responsibility for handling, placing, compacting, finishing, and curing passes to you.
11. Quality Complaints
Any issue with quantity, visible defect, or incorrect product must be reported as soon as possible and within 48 hours of delivery.
You must give us a fair chance to inspect and investigate before any remedial work is carried out, unless emergency action is needed.
12. Cancellations
Where a pump has been booked, we must be notified of any cancellation by 12.00 pm on the previous working day of delivery. If notified after this time, then charges may apply.
Orders for concrete may be cancelled without charge if you notify us at least 2 hours before the concrete is due on site. If a pump is booked in conjunction with the concrete, then charges for the pump will apply.
If you cancel within 2 hours of the concrete being due on site and the concrete has not been batched, or it is to be delivered on a mix-on-site truck, then a £200 cancellation charge plus VAT will apply.
If you cancel within 2 hours of the concrete being due on site and your concrete has already been produced or dispatched, then you will be charged the full amount for the concrete produced plus any applicable disposal charges.
13. Liability
Nothing in these terms excludes liability where it cannot legally be excluded.
If you are a consumer, your statutory rights are not affected.
If you are a business customer, our liability for any claim arising from the goods or services supplied will not exceed the invoice value of the relevant order, to the fullest extent permitted by law.
We are not responsible for damage caused by the normal weight or movement of our vehicles on surfaces or access routes you have provided, unless caused by our negligence.
14. Health & Safety
Wet concrete is highly alkaline and can cause serious burns.
Suitable PPE, including gloves, eye protection, and appropriate clothing, must be worn at all times when handling concrete.
Our drivers may refuse delivery or stop work if they believe site conditions are unsafe.
15. Consumer Rights
If you are ordering as a consumer, nothing in these terms affects your legal rights.
Because ready-mix concrete is made to your specification and is perishable, cancellation rights that may otherwise apply to online sales may not apply once production or dispatch has begun, to the extent permitted by law.
16. General
These terms are governed by the laws of England and Wales and any disputes will be subject to the jurisdiction of the courts of England and Wales, except where consumer law says otherwise.
